ARTICLE 1 – DEFINITIONS
Under these General Conditions of Use, all the following terms, including a capital letter, have the meaning indicated below and are understood both in the singular and in the plural:
Announcement: Refers to an announcement concerning a space offered for rental and published by ST TROPEZ KEY through the Site and, where applicable, the Application;
Application: IT Solution that allows the User to use the Features and Services offered by ST TROPEZ KEY;
CGU: The General Conditions of Use are made available on the Site. They define and delimit the conditions of use for any person who accesses and uses the Site;
Client: User who has reserved a Space through the Site or the Application;
STROPEZ KEY Commission: percentage of the Rental Price collected by STROPEZ KEY and paid by the Customer for each Reservation validated by the Owner;
Data: Any element (information, texts, photographs, messages, etc.) collected by the Customer and implemented by him within the Site and the Services through its use;
Personal Data(s): means any information relating to an identified or identifiable natural or legal person; is deemed to be an “identifiable natural or legal person” a natural or legal person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, a online identifier, or to one or more specific elements specific to his physical, physiological, genetic, psychological, economic, cultural or social identity;
STTROPEZ KEY: SAS, with a capital of €10,000.00, whose registered office is located at 59, Avenue du général leclerc, 83990 SAINT-TROPEZ registered in the FREJUS trade and companies register under number 841 717 812, represented by Mr. ITHIER MANUEL as Manager;
Space(s): means all property belonging to the Owner or rented by the Owner on his behalf and which he makes available to the Customer;
Functionality: Each element implemented, accessible and usable within the different Services;
Private message: message sent by a User to another User via the messaging system available on the Personal Account of each User;
Means of Access: Methods and/or function by which a Customer can access one or more Services in order to use them for his own needs;
Operator: Company that operates various electronic telecommunications networks necessary to access and use the Services;
Paid Option: refers to the additional options made available to the Customer by the Owner or by ST TROPEZ KEY as part of the Services and which are provided by Third Parties selected by ST TROPEZ KEY;
Party: Persons who have signed and adhere to the T&Cs and the obligations contained therein;
Period: means the duration (in calendar days) during which the Customer will have access to the Space made available to him by ST TROPEZ KEY;
Owner: Designates any legal person or any natural person who owns the property rented out by ST TROPEZ KEY on its website www.sttropezkey.com.
Reservation: Refers to a right granted by st tropez key to a Customer to use the Space, subject of the Advertisement, during the Period agreed between them;
Services: All the services made available to the Customer by ST TROPEZ key and accessible via the Means of Access;
Site: the website of st tropez key namely: www.sttropezkey.com;
Third parties: Refers to natural or legal persons who are not linked by common ownership or control to ST TROPEZ KEY or other individuals unrelated to ST TROPEZ KEY and/or the User;
User: means any natural or legal person accessing the Site.
ARTICLE 2 – PURPOSE OF THE GENERAL CONDITIONS OF USE
The purpose of these General Terms and Conditions of Use is to define the terms of provision of the Services of the Website www.sttropezkey.com and the conditions of use of the Service by the User.
By connecting to the Site, the User expressly acknowledges having read these General Conditions of Use and undertakes to comply with them.

ARTICLE 3 – ACCEPTANCE OF THE GENERAL CONDITIONS OF USE
These General Terms and Conditions of Use apply to all the Services made available by ST TROPEZ KEY on the Site and, where applicable, the Application as presented in ARTICLE 4 – “Site description”.
The T&Cs can be consulted at any time on the Site and, if applicable, the Application at the following email address:
The simple connection by any person to the Site and/or the Application and/or the Services implies full acceptance of the T&Cs.
As such, the User alone undertakes to read the T&Cs when first accessing and throughout the connections he makes.
The User accepts that the T&Cs are not sent to him on paper.
Access to the Site and the Services is free and free but is subject to acceptance of the T&Cs.
The simple connection to the Site will imply full and complete acceptance of these T&Cs. In addition, the User undertakes to have read it before registering.

ST TROPEZ KEY provides an online platform, accessible at ST TROPEZ KEY, to digitize the search and rental of real estate belonging to individuals and located exclusively in the Gulf of Saint Tropez.
In this respect, ST TROPEZ KEY acts as a real estate agent with a rental mandate with the Owners concerned.
Any User can thus access the Site in order to access advertisements for the rental of real estate for a short period, put online by ST TROPEZ KEY.
The Site makes it possible to compare rental offers and to book a rental online, for dates determined by the User, subject to validation by ST TROPEZ KEY.
These Services are accessible on the Site www.sttropezkey.com and, where applicable, in the form of an Application for mobiles, tablets and other smart devices and application program interfaces.
The User can consult the Advertisements, even if he is not registered on the Site, the Application or the Services.
The ST TROPEZ KEY Site is available in French and English.
ARTICLE 5 – ACCESS TO THE SITE
Simple access to the site does not require an access code or identifiers.
The Site as much as the Services are accessible and usable twenty-four hours a day (24 hours a day) and seven days a week (7 days a week) provided that you have a computer terminal allowing you to connect to the Internet network and of internet access.
The Site is accessible free of charge to any User with Internet access. All costs relating to access to the Service, whether hardware, software or internet access costs, are the sole responsibility of the User. He is solely responsible for the proper functioning of his computer equipment as well as his access to the Internet.
ST TROPEZ KEY reserves the right to refuse access to the Service, unilaterally and without prior notification, to any User who does not comply with these T&Cs or the Site’s T&Cs.
ST TROPEZ KEY implements all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to do so.
ST TROPEZ KEY cannot, moreover, be held responsible for any malfunction of the network or servers or any other event beyond reasonable control, which would prevent or degrade access to the Service.
ST TROPEZ KEY reserves the right to interrupt, temporarily suspend or modify access to all or part of the Service without notice, in order to ensure maintenance, or for any other reason, without the interruption entitles you to any obligation or compensation.
The Site, the Application and the Services are intended only for persons of legal age and with legal capacity. Any access or use of the Site, the Application or the Services by a person under the age of majority is strictly prohibited, except with the prior and express consent of their legal representatives.
By accessing or using the Site, the Application or the Services, the User declares and guarantees that he is of legal age and has full legal capacity.

ARTICLE 6 – DESCRIPTION OF SERVICES

Know the weather conditions, access a map of good addresses recommended by ST TROPEZ KEY and read the latest news published by ST TROPEZ KEY via the digital “dashboard”
Be offered a series of activities carefully selected by ST TROPEZ KEY;
Benefit from essential telephone numbers such as certain taxi companies, hospitals, the police, or even the fire brigade;
Take note of the rules of procedure of the Space;
Give their opinion on the rental and assign a score out of 5;
Declare an incident by email.

ARTICLE 7 – Customer Reviews
ST TROPEZ KEY encourages Users to post a review on rentals. Users can only post a review on a rental they have made.
7.1 Verifications
ST TROPEZ KEY may, at its sole discretion, and for the purposes of transparency and improvement of the Service, carry out verifications of the information provided by the User when creating the Account and during the rental period.
ARTICLE 8 – PUBLICATION OF ANNOUNCEMENTS
The Advertisements published on the Site are published by ST TROPEZ KEY exclusively, under its own responsibility.
ARTICLE 9 – EXCLUSION FROM THE SITE
In the event of a particularly serious breach, ST TROPEZ KEY reserves the right to exclude a User without notice or the right to reimbursement.
These cases are listed below:
Non-respect of the rights of Third Parties (for example non-respect of a co-ownership regulation, etc.);
Cancellation of Reservations 2 (two) consecutive times.
ARTICLE 10 – OWNERSHIP OF THE ELEMENTS PRESENT ON THE SITE
With respect to everything it publishes on the Site, ST TROPEZ KEY has and retains all rights, titles and interests for their patents, inventions, actor’s rights, trademarks, domain names, know-how and any right of intellectual property.
All the photographs published on the Site are published with the authorization of the Owners, any reproduction of the said photos being strictly prohibited whatever the medium, without the prior and express contribution of ST TROPEZ KEY and the Owner concerned.
ST TROPEZ KEY is and remains the owner of the property rights relating to any element of the Services and Functions on the Site made available to the User, and more generally as to the IT infrastructure implemented, developed and made available in the framework of the Services.
The provision of the Services and Functions cannot be analyzed as the transfer of any intellectual property right for the benefit of the User. The User is prohibited from reproducing any element of the Services, the Site, or any documentation concerning them, by any means whatsoever, in any form whatsoever and on any medium whatsoever without the prior and express consent of ST TROPEZ KEY.
ARTICLE 11 – EXCLUSION OF LIABILITY
11.1. Operation of the Site
As for the operation of the Site and the Services, ST TROPEZ KEY is subject to a general obligation of means.
In the event of interruption of access or use of the Site and/or Services, ST TROPEZ KEY may only be held liable if said interruption is prolonged or constant or by its own doing and cannot be resolved within reasonable deadlines.
In the event of force majeure or action(s) performed by any Third Party and/or damage(s) caused by any Third Party, ST TROPEZ KEY cannot be held liable.
St tropez key can in no way be held liable for any inconvenience or damage inherent in accessing and/or using the Internet and/or electricity network, in particular in the event of a break in service(s). , external intrusion(s) or presence(s) of computer viruses. The same applies with regard to the needs, questions or problems of compatibility, interoperability and/or qualities inherent in the use of any physical or technical means allowing access to the Site or the Services.
11.2. Information on the Site
The Site, the Application and the Services constitute an online platform on which ST TROPEZ KEY key creates and publishes Advertisements for the rental of Spaces that other Users can consult to obtain information or to reserve the said spaces directly with of ST TROPEZ KEY.
ST TROPEZ KEY is neither the owner nor the operator of Spaces.
In this respect, ST TROPEZ KEY is not responsible for the security elements or compliance with the standards of the Spaces and can in no way be responsible for the actions of customers.
ST TROPEZ KEY is limited to a connection role within the framework of a property management mandate.
The User agrees to do nothing to create the false impression that he is supported by, in partnership with, or acting in the name or for the benefit of ST TROPEZ KEY, in particular by inappropriate use of any intellectual property of ST TROPEZ KEY.
ST TROPEZ KEY shall not be liable for any prejudice or damage that may result from the use by a User of the information present on the Site, nor from errors or omissions in it, from defects or interruptions in their supply or from the unavailability of all or part of these.
The User acknowledges that the data circulating on the Internet is not protected in particular against possible misappropriation.
The User acknowledges that the data circulating on the Internet may be regulated in terms of use or be protected by a property right. The User is solely responsible for the use of the data he consults, queries and transfers on the Internet.
The User acknowledges that ST TROPEZ KEY has no way of controlling the content of the services accessible on the Internet.
11.3. Hyperlinks
The hypertext links present on the site directing users to other Internet sites do not engage the responsibility of ST TROPEZ KEY as to the content of these sites.
ARTICLE 12 – PERSONAL DATA
Pursuant to Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018 and the General Data Protection Regulations (GDPR) which entered into force on May 25, 2018, it is recalled that the personal data requested from the Customer are necessary for the processing of his order and the establishment of invoices, in particular.
This data may be communicated to any partners of ST TROPEZ KEY responsible for the execution, processing, management and payment of rentals, as well as to the Owners.
The processing of information communicated via the Site meets the legal requirements for the protection of personal data, the information system used ensuring optimal protection of this data.
The Customer has, in accordance with the national and European regulations in force, a right of permanent access, modification, rectification, opposition to portability and limitation of processing with regard to information concerning him.
ARTICLE 13 -BLOCTEL
The processing of the order involving the collection of your telephone data, you can register free of charge, in accordance with articles L.223-1 and R.223-1 of the Consumer Code, your telephone number on the site “http:// www.bloctel.gouv.fr/” on a list of opposition to canvassing, called “Bloctel”.
This registration allows you not to be solicited by telephone about a commercial offer.
It is recalled that this objection is not applicable in particular:
In the event of pre-existing contractual relations between the professional and the consumer, unless the consumer expressly refuses to be contacted by telephone;

ARTICLE 14 – MODIFICATION OF THE GENERAL CONDITIONS OF USE
These General Conditions of Use may be modified at any time by ST TROPEZ KEY, unilaterally and without notice. The General Conditions of Use applicable to the User are those in force on the day of his connection to the Site, any new connection entailing acceptance, where applicable, of the new General Conditions of Use.
Any modification of the T&Cs is the subject of information intended for the User from the Site.
ARTICLE 15 – PARTIAL NULLITY
The possible cancellation of one or more clauses of this contract by a court decision or by mutual agreement between ST TROPEZ KEY and a User cannot affect its other stipulations which will continue to produce their full and complete effect for as long as the general economy of the contract can be safeguarded.
ARTICLE 16 -LANGUAGE
These General Conditions of Use are written in French. In the event that they are translated into one or more languages, only the French text shall prevail in the event of a dispute.
ARTICLE 17 – APPLICABLE LAW
These T&Cs are governed by French law.
ARTICLE 18 – COMPETENT JURISDICTION
All disputes to which this contract may give rise, concerning its validity, interpretation, execution, resolution, their consequences and their consequences will be submitted to the competent court under the conditions of common law.
Prior to any litigation, the parties must attempt to settle their disputes amicably.
